Need Some Advice Regarding Poor Customer Service and ABH attack..?

Ok where do I start... I purchase this lead from a well known electrical store . The lead was faulty and it states on back of receipt u can return it within 28days and get refund which we were trying to achieve. As the lead was out of the box she refered to this young guy next to her on the phone on hold who said rudely ';u aint gettin no refund'; and turned his back. My husband was in middle of explaining to him so tapped him on the back with a box( he was still on hold). But he just turned round and mumbled something - so my husband tapped him agian with the box to get his attention as wanted an explanation why he couldnt get a refund and his reason for asking for one. Sales guy then turned round and said to my husband ';wait till you get outside';. Well anyway my husband was annoyed and said okay he will have an exchange if not refund so he picked up box and went outside as he went outside this sales guy grabbed him by his scarf stranggling him. My husband tried to push him but theNeed Some Advice Regarding Poor Customer Service and ABH attack..?
I suppose punching a customer in the face and strangling them is pretty poor customer service.





It does not look like the police want to get involved.


You have the option of making a formal request they do so and complaining to the Police Ombudsman if they do not, or taking civil action.





You can take a civil claim for assault (it's a tort) against the salesperson and his employer.


Damages would be limited to those for the injury sustained - there's no penal element.


If the injuries were minor, get a GP report and issue the claim yourself (local county court, they have the forms) limiting damages to 拢1,000.

go for the throat,this is actual bodily harm,your husband may be an absolute prat for tapping the salesman with the box,but did no damage.You can insist that the police make a case,they were trying to fob you off and this is normal in these cases.Your husband may also be proceeded against by the salesman ,as was pointed out,but no injury was intended or sustained ,making it a common assault.The salesman,on the other hand faces much more severe charges.HAVING SAID ALL THIS,IF YOUR HUSBAND TAPPED ME WITH A BOX ,I WOULD FLATTEN HIM.He could look on this as a lesson learned and let it go,but the salesman certainly needs teaching some manners,i would not have treated you this way,patience is a virtue.
Technically in law your Husband assaulted this salesman twice by ';tapping'; him with the box. As you were not present in the store you don't know what happened or what was said, all you can say is, you saw what happened outside. I have always found staff very helpful when I have returned goods, so this all seems a bit odd. Write to the Chief Executive of the company if you feel so strongly, or let the Police sort it out.
Goodness, I thought service in shops was getting bad as most of the time they act as if they're insulted they have to serve you, but none has hit me yet. I suppose tapping the assistant probably annoyed him a lot though. The shop assistant could have called the police if you husband was hitting him with a box and your husband could have been banned from the store, but he didn't take the correct route so they are both at fault.
